Terms of Service

These Terms of Service ("Terms") apply to your use of the 8Bit Technologies website and of Orbit, our work-management service used to plan, review, approve and publish content for clients (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, please do not use them.

1. Who may use the Services

The public website is open to everyone. Orbit is available only to people whom 8Bit Technologies has given an account: our staff, and users of our clients. You must have the authority to accept these Terms for yourself or, if you use Orbit on behalf of a business, for that business.

2. Accounts and security

• Keep your sign-in details confidential and do not share your account.
• You are responsible for activity under your account. Tell us promptly at support@8bittechnologies.com if you think it has been used without your permission.
• We may suspend or deactivate an account to protect the security of the Services or the people who use them.

3. Acceptable use

You agree not to:

• break the law or infringe anyone's rights while using the Services;
• try to access accounts, clients or data that you are not permitted to see, or to bypass security or access controls;
• upload malware, or interfere with or overload the Services;
• copy, resell or reverse engineer the Services, except as the law allows;
• use the Services to publish content that is unlawful, misleading, infringing or abusive, or that breaks the rules of the platform it is published on.

4. Client content

"Client content" means the text, images, video, files and other material that you or we place into Orbit for a client. You keep your rights in your content. You give 8Bit Technologies permission to store, process, display, review and, when it has been approved, publish that content as needed to provide the Services. You are responsible for having the rights to content you supply and for approving only content that you are comfortable having published.

5. Third-party services (Meta and Google)

Orbit works with third-party services, including Facebook and Instagram (Meta) and Google Drive and Google Sheets. Your use of those services is governed by their own terms and policies, including Meta's Platform Terms and Google's terms. They are not under our control, and they may change or become unavailable, which can affect what Orbit is able to do. Where Orbit publishes to a Facebook Page or an Instagram account, we do so only through an account that has the necessary access to that Page, and only to the Page that has been assigned to the relevant client.

6. Privacy

Our Privacy Policy explains how information is handled, and forms part of these Terms. To ask for information to be deleted, see Data Deletion.

7. Intellectual property

The Services, including their software, design, text and branding, belong to 8Bit Technologies or its licensors and are protected by law. These Terms give you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose, and nothing more. The 8Bit Technologies name and logo may not be used without our permission.

8. Availability and changes

We work to keep the Services available and accurate, but we do not promise that they will be uninterrupted or error-free. We may maintain, change, add or remove features, and we may update these Terms. If we change the Terms, the date above will be updated, and continuing to use the Services after a change means you accept it.

9. Termination

You may stop using the Services at any time. We may suspend or end your access if you break these Terms, if your account is no longer needed, or if we need to do so to protect the Services or others. When access ends, the provisions that are meant to continue (such as those on intellectual property, disclaimers and liability) continue to apply. You can ask for information to be deleted as described on our Data Deletion page.

10. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent the law allows, we do not give warranties of any kind, whether express or implied, including about fitness for a particular purpose, uninterrupted operation, or that content will be published at a particular moment or reach a particular audience. Publishing depends on third-party platforms that we do not control.

11. Limitation of liability

To the fullest extent the law allows, 8Bit Technologies will not be liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising from the use of or inability to use the Services. Nothing in these Terms limits liability that cannot lawfully be limited.

12. Governing law

These Terms are governed by the laws of India. If a dispute arises, please first contact us so that we can try to resolve it in good faith.
